Terms and Conditions
Definitions
The “Company” means Clomm Limited, its affiliated companies and any authorized person of Clomm Limited and its affiliates.
The “Customer” means any person who places an order.
The “Member” means any person who successfully registers an account on www.clomm.com
The “Goods”’ means any goods described in the order.
An “Order” means a request by the Customer for Goods subject to these Terms and Conditions.
The "Website" means www.clomm.com
Acceptance of Terms and Conditions
Prior to placement of an Order, the Customer should have read these terms and conditions thoroughly and agreed to be bound by them.
Membership Registration
.The Customer will be able to purchase Goods on the Website with use of the username and password after he or she successfully registers to be for an account.
.Information supplied by each Member is understood to be complete and correct at time of registration.
.Each Member must safeguard his or her username and password.
.The Company assumes that only the party that uses the username and password represents either the Member or any person authorized by him or her.
.It is the Member’s responsibility to update the record with the Company without delay of any changes of personal information.
.The Company shall have sole discretion to accept or terminate the registration of any Customer as a Member.
Prices
All products are listed in US dollars by default. The Customer may choose to view and pay in USD, GBP, EURO, JPY or HKD. The displayed prices do not include taxes or delivery charges. The Company reserves the right to update prices on the website at any time without prior notice. The Company, however, makes every effort to ensure prices shown are up-to-date.
Order
Only Customers who have registered an account on the Website can make an order on the Website. Only persons over eighteen years of age can place an order.
Steps of placing an order
1. Select products by adding them to your shopping cart
2. Log-in the Member’s account on the Website
3. Checkout when the order is ready to be placed
4. Verify delivery and contact information
5. Receive a confirmation email and an electronic invoice
Goods are sold on a first-come-first-served basis, subject to their availability while stocks last. Very occasionally, the Company may run out of a particular product without notice. The Company accepts no responsibility for its inability to supply Goods to the Customer where the product is unavailable and shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order. In any event that an Order is unfulfilled or partially unfulfilled, the Customer will be notified by email. The Company reserves the right to decline an Order to any Customer at its sole discretion.
Presentation of Goods
While the Company takes every precaution in the preparation of all information on the Website, it does not guarantee the accuracy or completeness of such information. Statements contained in any literature shall not constitute representations by the Company and the Company shall not be bound by them. Any typographical, clerical or other error or omission in any literature issued by the Company shall be subject to correction without any liability on the part of the Company. If there are colour differences between the colours shown on the Website on the Customer’s computer and the actual colours of the Goods, this may be due to the colour reproduction on the Customer’s computer. The Company accepts no responsibility at any time for any revision or change in the style of packaging which does not materially affect the Good’s quality.
Payment
Goods can be released only after full payment has been received. The Company accepts online payment by Paypal, a secure online payment gateway that encrypts card details in a secure environment. To create a Paypal account, please visit www.paypal.com to register. If the Customer wishes to pay quickly with a credit card, please select the PayPal Express Checkout option when directed to Paypal. The Company reserves the right to change the payment terms for any Order without prior notice
Delivery
The Company delivers Orders to the following countries: Argentina, Austria, Bahrain, Belgium, Brazil, Canada, China, Denmark, Finland, France, Germany, Hong Kong, Ireland, Italy, Japan, Netherlands, New Zealand, Norway, Portugal, Qatar, Saudi Arabia, Singapore, Spain, Sweden, Switzerland, Taiwan, United Arab Emerates, United Kingdom, USA.
The Company endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. The Company aims to deliver within the specified delivery times for your region, following payment confirmation of an order. Details of delivery times and shipping rates are described on the “Support” pages of the Website under “Delivery”. The shipping rates do not include taxes or other charges, for which the Company is not responsible. The Company shall use its reasonable endeavours to meet any date agreed for delivery. In any event, the Company shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. The Company will not be liable if it fails to deliver Goods in part or in full due to circumstances beyond its control. The Company reserves the right to decline delivery of goods to any Customer at its sole discretion.
Return Policy
Webshop Returns
Customers who are not satisfied with the Good can return it to the Company for an exchange or refund within 14 Days of order receipt. Customer may receive a full refund for the amount paid for the Good. All shipping costs related to exchange are to be paid by the Customer. The Company only accepts returns for Goods purchased directly from the Website. Goods returned for refund or exchange must be unused and in original condition, with undamaged packaging and any and instruction booklets. Returned items that are damaged in the Company’s opinion may not be accepted and will be sent back to the customer. To make a webshop return, please email the Company at info@clomm.com with order receipt number to receive a Returns Registration Form with a Returns Number and return instructions. Goods sent to the Company without a Returns Registration Form and a Returns Number will not be accepted.
Retail Shop Returns
If the Customer has purchased Goods from a Company- authorized retailer and wish to return it within 14 days of purchase, please contact them directly for returns procedure. Please note that the return policies of the Company’s dealers vary and are made based on their discretion. Returned items that are damaged in the retail partners’ opinion may not be accepted and will be returned to the customer.
Title and Risk
The Company shall retain title to all Goods sold by it until the full payment due from the Customer has been received. Risk in all Goods shall pass to the Customer upon delivery of the Goods.
Copyrights
All rights, including copyrights and other intellectual property rights at the Website remain with the Company. Any use of the Website or its contents, including copying or storing it or them in whole or part, other than for personal, non-commercial use is prohibited without the permission of the Company.
Force Majeure
The Company shall not be liable to the Customer for any loss or damage caused to or suffered by the Customer as a direct or indirect result of the supply of the Goods by the Company being prevented, restricted, hindered or delayed by reason of any circumstance outside the control of the Company which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activities. The Company’s total liability to the Customer for any loss or damage arising in connection with this Agreement shall be limited to the total price of the Customer’s Order.
Jurisdiction
The above Terms and Conditions and the contract shall be subject to and construed in accordance with the Law of the Special Administrative Region of the People's Republic of China in Hong Kong. The Company has absolute discretion to revise any of the above Terms and Conditions at any time without prior notice.
